The draft Bill states that premises and events must be accessible to the public and can be a building, group of buildings or outdoor location which have a readily identifiable physical boundary
The draft Martyn's Law Bill specifies a number of activities that are in scope of the draft legislation. Education is one of these activities.
To ensure the legislation is proportionate, maximum capacity of a building/group of buildings or event has been used to determine those premises in scope. There will be 2 tiers of the proposed Duty: The Standard Tier will apply to all premises with a maximum capacity of between 200 and 799. An Enhanced Tier will be for any premises or events with over 800 maximum capacity. Settings with a maximum capacity below 199 are not legally within scope.
